This Privacy Policy applies to NSW Police Legacy Limited (ABN 70 051 341 087) ("NSW Police Legacy Limited”, "We", "Us" or "Our") including the handling of personal information through all of the websites that we own and/or operate such as www.nswpolicelegacy.org.au.
We are committed to respecting your privacy and are bound to comply with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) ("Privacy Act").
By providing us with your personal information, you allow us to collect, use and disclose your information in accordance with this Privacy Policy.
Please note that our website may contain links to external websites operated by third parties. We do not control how any of these third parties handle your personal information. This privacy policy does not apply to your use of any of those websites or any of your interactions with those third parties.

Kinds of Personal Information that is collected
Personal information is any information which identifies you or could reasonably identify you. Personal information includes sensitive information such as information about your health ("health information"), religion and sexual orientation.

Legatee:
- your name and contact details (e.g. telephone number, email address);
- your government identifiers (e.g. your Medicare number); and your private health insurance number;
- health information, including whether you require any specific support or modification of our services because of any health concerns;
- information about the services that we provide to you, including any information that you choose to provide to us regarding your sexual orientation and/or religion in support of your request
- that we provide you with our services; and
- your bank account details.
Family of a Legatee and Parents Network
- your name and contact details (e.g. telephone number, email address);
- your government identifiers (e.g Medicare number);
- health information, including whether you require any specific support because of any health concerns;
- your relationship to the Legatee;
- information about the services that we provide to you; and
- your bank account details.
Donor or fundraiser or corporate contact or support networks
- your name and contact details (e.g. telephone number, email address);
- your role or connection to the NSW Police force and registered number for NSW Police Officers(if any).
Applicant for a job or position with us (e.g. volunteer or contractor)
- your name and contact details (e.g. telephone number, email address); and
- information about any current or prior employment, volunteer work or contracting arrangements undertaken by you; and
- relevant skills.
Attendees at an event that we host or sponsor
- your name and contact details (e.g. telephone number, email address);
- information about your current or former role(s); and
- information relevant to the event(s) that you attend (such as dietary requirement and emergency contact).
How Personal Information is collected
We may collect personal information either directly from you, or from third parties (if you provide us with your consent to do so, or if it is otherwise unreasonable or impracticable to collect that information from you directly), including:
- by you completing and sending to us any of the forms published on our website; and
- when your personal information is otherwise provided to us in the course of us providing you with our services, or handling an enquiry or request for information that you have made.
When you apply for a job or position with us, we may collect information about you from third parties such as from recruitment consultants, previous employers and other persons who might be able to provide information to assist us to decide whether or not to make you an offer of employment or engage with you under a contract.
You can request that we not identify you in any of your dealings with us, but please note that we are not required to comply with this request if it would be impracticable for us to deal with you without having identified you.
3. Personal Information that you provide to us about another person
If you provide us with personal information about another person (e.g. a referee, a person to whom you may wish a payment to be made or your family member), you must ensure that you are authorised by them to do so. You should inform that person as to who we are and the fact that we will collect, use and disclose their personal information in accordance with this privacy policy.
4. Collection, Use and Disclosure of Personal Information
We may collect, use and disclose your personal information for any of the following purposes:
- to enable us to provide you with our services and to handle any enquiries, or other requests for information that you have made;
- to facilitate the making of a donation or a fundraiser organised by you;
- to request that you provide us with donations, funding or become engaged in a fundraiser (although you may opt-out of receiving these kinds of communications by using the contact details set out below or by following the opt-out instructions that will be provided to you in our communications);
- to inform you about our services and to provide you with copies of our quarterly newsletters (although you may opt-out of receiving these kinds of communications as set out above);
- to facilitate your attendance at an event that we host or sponsor;
- to develop our services, for example, by performing analytics on your use of our website;
- to carry out our administrative and business operations, including accounting, risk management, record keeping, archiving, systems development and testing, and training activities;
- to consider any application for a job or position you make with us; and
- to carry out our obligations or exercise our rights under the law.
We may disclose your personal information, for any of the above purposes, to:
- our employees, volunteers and contractors (e.g. payment processors), noting that these persons will be subject to confidentiality agreements to protect your personal information;

- your trustee, guardian or attorney, and advisers;

- our insurers in relation to any actual or potential claim made by or in relation to us; and
- government departments, regulatory bodies and law enforcement agencies.
Your personal information will usually only be disclosed to third parties if you provide us with your consent to do so. For example, we may ask for your consent to publish your name on, for example, our website if you become one of top fundraisers for a specific cause. However, there will be no consequences if you do not consent to us doing this.
5. Disclosure of Personal Information to overseas recipients
We may disclose your personal information to overseas recipients if necessary for any of the purposes set out in this privacy policy. It is not practicable for us to specify all of the countries in which these overseas recipients are likely to be situated. However, we may disclose your personal information to our service providers based in the United States of America for the purposes of them providing us with their services (e.g. auctioneer services for the Blue Ribbon Ball).
Clause 8.1 of the Australian Privacy Principles states that if we disclose personal information about an individual to an overseas recipient, then we must take such steps as are reasonable in the circumstances to ensure the overseas recipient does not breach the Australian Privacy Principles in handling that information. An exception to this is if we obtain your consent to disclose that information to an overseas recipient without these protections. We intend to rely on this exception - so, unless you notify us in writing to the contrary, you will be taken to have consented to the disclosure by us of personal information to overseas recipients on the basis that:
- clause 8.1 of the Australian Privacy Principles will not apply to such disclosure;
- the overseas recipient may not be subject to obligations that provide a similar level of protection for your personal information as is the case under the Australian Privacy Principles;
- you will not be able to seek redress under the Privacy Act 1988 (Cth) against the overseas recipient in relation to their handling of your personal information; and
- the overseas recipient may be the subject to a foreign law that could compel the disclosure of personal information to a third party, such as an overseas authority.
5. Access to or correction of your Personal Information
You can access the personal information that we hold about you by contacting us using the details set out below.
Sometimes, we may not be able to provide you with access to all of your personal information and where this is the case, we will tell you why. You may be required to pay us a reasonable, cost-based fee if we provide you with access to your personal information.
6. Security of Personal Information
We will take reasonable steps to ensure that your personal information is accurate, complete and up-to-date. If at any time you believe that personal information that we hold about you is inaccurate, incomplete or out of date, you can also contact us and request that this information be corrected using the contact details set out below.
We maintain strict procedures and standards and take all reasonable care to prevent unauthorised access, disclosure, misuse, and loss to your personal information.

7. Cold calling and telemarketing
We do not engage in any cold calling or telemarketing. Any information that we provide to you about our services and/or funding opportunities will only be sent to you in writing.

We will only use and disclose your government identifiers to verify your identity, or as otherwise required or permitted by law.
We will not use and disclose your tax file number, Medicare number, pension number or any other government identifier as your account number.
If you think we have breached the Privacy Act, or you wish to make a complaint about the way we have handled your personal information, you can contact us using the contact details set out below.
Please specify your name, email address and/or telephone number, and clearly describe your complaint. We will acknowledge your complaint and respond to you within a reasonable period of time.
If you think that we have failed to handle your complaint satisfactorily, please let us know and we will provide you with further information about the steps you can take.
